Overview

These Terms and Conditions regulate the sale of products, installation services, and maintenance services supplied by Modirong Holdings (Pty) Ltd trading as Modirong Solar. By purchasing products or services from the company, the customer agrees to these terms.


Definitions

Company refers to Modirong Holdings (Pty) Ltd.

Customer refers to the purchaser of goods or services.

Products include solar components such as:

  • Solar panels
  • Inverters
  • Batteries
  • Solar geysers
  • Electrical accessories
  • Monitoring equipment

Services include:

  • Solar system installation
  • System commissioning
  • Maintenance and diagnostics
  • Solar care plan services

Installation Terms

Installation services are provided according to the agreed quotation and system design.

The customer must ensure:

  • Safe site access
  • Compliance with electrical standards
  • Adequate installation space
  • Structural suitability

If the installation site is unsafe or non-compliant, installation may be delayed until rectified.


Commissioning Requirements

All inverter systems above 2.5kVA must be commissioned by an authorised technician of the company.

Failure to perform proper commissioning may result in:

  • Reduced system performance
  • Invalid manufacturer warranty
  • Additional service costs

Solar Care Plan Services

Where a customer subscribes to a Solar Care Plan, services may include:

  • Scheduled system inspections
  • Battery diagnostics
  • System performance monitoring
  • Preventative maintenance

Failure to maintain subscription payments may result in suspension or cancellation of services.


Initial System Inspection

Before accepting a system into a Care Plan, the company may conduct a system inspection.

If the system does not meet operational or safety standards, corrective work may be required before acceptance.


Ownership of Goods

All goods remain the property of the company until full payment has been received.

The company reserves the right to reclaim goods where payment has not been made.


Payment Terms

Payment terms will be specified on the quotation or invoice.

The company reserves the right to charge interest on overdue accounts.


Limitation of Liability

The company shall not be liable for:

  • Loss of business
  • Loss of profits
  • Data loss
  • Power supply interruptions
  • Consequential damages

System performance depends on environmental conditions, grid stability, and customer usage.


Force Majeure

The company shall not be liable for delays or failure caused by events beyond reasonable control including:

  • Natural disasters
  • Supply chain disruptions
  • Transport failures
  • Government restrictions

Variation of Terms

No variation of these Terms and Conditions shall be valid unless confirmed in writing by the company.


Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.


System Performance Disclaimer

Solar system performance, battery backup duration, and energy production are estimates and may vary due to:

  • Weather conditions
  • Seasonal solar irradiation
  • Customer electricity consumption
  • Battery cycling behaviour
  • Grid stability
  • Environmental conditions

The company does not guarantee specific backup durations or power output unless stated in writing.
